1. Acceptance of Terms

These Terms and Conditions govern access to Urmate, including the website, dashboard, study tools, AI features, templates, builder tools, communication features, billing flows, and related services operated by flyingdarkdev. By visiting the website, creating an account, using free features, subscribing to paid features, connecting third-party providers, or uploading content, the user accepts these Terms. The Terms also apply to users who access the platform through invitations, partner links, trials, coupons, or organization accounts.

If a user does not agree, the user should stop using the service and should not create or continue an account. Continued use after a policy update may be treated as acceptance to the extent permitted by applicable law, especially where the updated Terms are made available on the website or inside the product.

2. Eligibility and Lawful Use

Users must be legally capable of using digital services under applicable law and must use the platform only for lawful purposes. Where a user is below the legally required age or uses the service through a school, parent, guardian, employer, institution, or organization, the responsible adult or authorized entity should supervise use and ensure that permissions are in place. Some features may depend on third-party providers that have their own eligibility rules.

Users must not use the service in a way that violates Indian law, local law, institutional rules, platform rules, or rights of another person. flyingdarkdev may restrict or refuse service where eligibility cannot be verified, where use creates legal risk, or where an account appears to be created for abuse, impersonation, fraud, spam, scraping, or unauthorized automation.

3. Account Registration and Security

Users are responsible for the accuracy of account information and for keeping login credentials safe. An account may include email, OAuth identity, username, profile details, workspace settings, payment records, prompts, files, generated content, and usage history. The user should keep recovery details updated and should report suspicious access promptly. Shared accounts are discouraged unless the product expressly supports team access.

Users must not sell, rent, transfer, or allow unauthorized access to their account. Urmate may suspend or secure an account if there is suspected compromise, credential sharing, bot activity, abnormal usage, payment risk, or a request from a verified owner. Account recovery may require identity, email, payment, or ownership verification.

4. Product Features and Changes

Urmate provides study, AI chat, builder, image generation, templates, project, search, provider routing, support, and productivity features that may evolve over time. Features may be added, removed, renamed, limited, paused, or changed based on technical needs, safety requirements, third-party provider availability, pricing changes, product direction, or legal obligations. Screenshots, demos, early access features, roadmap notes, and marketing descriptions may not represent permanent functionality.

Users should not rely on a feature being available forever unless a written contract says so. flyingdarkdev will try to make changes responsibly, but it does not guarantee uninterrupted access, backward compatibility, identical output quality, or permanent availability of third-party models, APIs, tools, templates, or integrations.

5. AI Output and User Judgment

AI features can produce helpful drafts, explanations, images, code, study notes, summaries, and suggestions, but output may be inaccurate, incomplete, outdated, biased, unsafe, or unsuitable for a specific purpose. The user is responsible for reviewing generated output before using it in exams, business decisions, public posts, client work, software, financial decisions, medical decisions, legal matters, safety-sensitive work, or academic submissions. AI output should be treated as assistance, not final professional advice.

Users should verify facts, sources, originality, rights, and compliance before publishing or relying on generated material. flyingdarkdev is not responsible for losses caused by blind reliance on AI output, misuse of generated content, or failure to review output where human judgment is required.

6. User Content and Ownership

Users may upload, write, import, generate, store, or share content through the platform, including prompts, notes, files, chats, images, projects, templates, and feedback. The user remains responsible for having rights to the content they submit and for ensuring that content does not violate privacy, intellectual property, confidentiality, contractual obligations, institutional rules, or applicable law. The platform may need to process content to provide features, troubleshoot issues, enforce policies, and maintain security.

Users should not upload confidential, regulated, or highly sensitive material unless they understand the feature, provider settings, and applicable rules. flyingdarkdev may remove, restrict, or preserve content where required by law, where a violation is suspected, or where content creates risk for users, partners, infrastructure, or the service.

7. Acceptable Use

Users must not use the platform for illegal, harmful, deceptive, exploitative, abusive, infringing, or disruptive activity. Prohibited conduct includes malware, phishing, credential theft, spam, fake reviews, harassment, impersonation, scraping at abusive scale, bypassing limits, probing systems without permission, generating unlawful content, violating third-party terms, or attempting to manipulate billing, referrals, coupons, credits, or usage quotas.

Users must also avoid using the platform to create misleading professional claims or harmful automated decisions. flyingdarkdev may investigate suspicious activity, limit access, remove content, block accounts, preserve logs, deny refunds, or report serious misuse to appropriate authorities where legally appropriate and necessary to protect the platform or other users.

8. Payments, Subscriptions, Credits, and Taxes

Paid plans, subscriptions, credits, add-ons, implementation services, partner fees, and usage-based charges are governed by the price, billing cycle, and conditions shown at checkout or in a written agreement. Amounts may include taxes, payment gateway charges, bank fees, foreign exchange differences, or provider-related costs depending on payment method and location. A successful payment does not override these Terms, abuse rules, provider rules, or refund restrictions.

Users should review plan details, renewal dates, quotas, credit validity, and cancellation requirements before purchasing. flyingdarkdev may change prices for future billing periods, correct obvious pricing mistakes, suspend paid access after failed payment, and require verification where transactions appear fraudulent, disputed, duplicated, or linked to chargeback misuse.

9. Refunds and Cancellations

Refund and cancellation handling is described in the Refund Policy and Cancellation Policy, which form part of these Terms. A cancellation normally stops future renewal; it does not automatically create a refund for the current billing period. Refund eligibility depends on the type of purchase, timing of request, level of usage, payment status, duplicate charge records, delivery status, policy abuse, and whether the service was materially unavailable due to a verified platform issue.

Users should submit refund requests with order ID, invoice ID, payment proof, account email, and reason. flyingdarkdev may reject refund requests involving consumed credits, generated output, custom work, repeated abuse, chargebacks filed before support review, or account suspension caused by serious policy violations.

11. Intellectual Property

flyingdarkdev owns or licenses the product interface, software, design system, workflows, documentation, trademarks, brand elements, databases, internal tools, and non-user content used to operate Urmate. Users receive a limited, revocable, non-exclusive right to use the service according to these Terms. This does not transfer ownership of the platform or permit copying, resale, sublicensing, reverse engineering, white-labelling, framing, automated extraction, or commercial exploitation outside allowed product use.

Users must respect third-party intellectual property when uploading or generating content. flyingdarkdev may respond to infringement notices, remove disputed material, suspend repeat infringers, and protect its intellectual property through technical, contractual, or legal measures where necessary.

12. Privacy and Data Handling

The Privacy Policy and Data Protection & User Rights page explain how personal data, account data, usage data, payment metadata, content, and support communications may be collected, used, shared, retained, and protected. Users should review privacy settings, provider integrations, file uploads, workspace sharing, and AI feature behavior before submitting sensitive information. Some processing may be required for authentication, security, payments, compliance, support, abuse prevention, and feature delivery.

Users may contact the published privacy or grievance email for applicable privacy requests. flyingdarkdev may retain limited records where required for legal compliance, tax, accounting, fraud prevention, dispute handling, security logs, backups, or legitimate business needs, subject to applicable law.

13. Suspension, Termination, and Restrictions

flyingdarkdev may suspend, restrict, or terminate access when required by law, when a user breaches these Terms, when payment fails, when security risk exists, or when continued access may harm the platform or other users. Restrictions may include temporary login block, feature limits, content removal, API limit reduction, workspace disablement, billing hold, or permanent termination. Serious issues such as fraud, malware, harassment, repeated chargebacks, fake complaints, illegal use, or attempts to bypass safeguards may lead to immediate action.

Users may stop using the service at any time and may request account closure where available. Termination does not remove payment obligations already incurred, refund restrictions, ownership provisions, liability limits, dispute provisions, privacy retention rules, or any section that must reasonably survive closure.

14. Disclaimers

The service is provided on an as-is and as-available basis to the extent permitted by applicable law. The platform does not guarantee uninterrupted access, error-free operation, perfect security, specific learning results, business revenue, job outcomes, model accuracy, provider availability, legal compliance of user-generated content, or that every bug will be fixed within a specific time. Product examples and sample reviews should not be treated as guaranteed outcomes.

Users are responsible for backups, review, validation, and lawful use of their own content. flyingdarkdev does not replace qualified legal, medical, financial, tax, academic, security, or professional advice, and users should consult qualified professionals where decisions carry serious risk.

15. Limitation of Liability

To the extent permitted by applicable law, flyingdarkdev, Urmate, and their team members are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages. This includes loss of profits, revenue, business opportunity, goodwill, data, content, account access, learning progress, generated output, or business interruption caused by use of the service, inability to use the service, third-party provider issues, user error, unauthorized access, or policy enforcement.

Some liabilities cannot be excluded under law, and those rights are not limited where exclusion is not permitted. Where liability can be limited, aggregate liability will be limited to the amount paid by the user for the affected service during the three months before the claim, or INR 5,000, whichever is lower, unless law requires otherwise.

16. Indemnity

Users agree to defend and indemnify flyingdarkdev, Urmate, and their team members from claims arising from user content, misuse, breach of policy, unlawful activity, or violation of third-party rights. This includes claims related to uploaded files, generated content, intellectual property disputes, privacy violations, partner misuse, payment disputes, chargeback abuse, fake complaints, unauthorized integrations, and content distributed outside the platform. Indemnity obligations may apply even after an account is closed if the claim relates to prior activity.

Users should keep evidence of rights, permissions, payment records, and lawful basis where relevant. flyingdarkdev may control defense of a claim where its interests are affected, and the user must cooperate reasonably in investigation, response, settlement, or legal defense.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India, subject to any mandatory consumer protection rule that cannot be waived. Unless applicable law requires another forum, courts or authorities having jurisdiction over India, India will handle disputes connected with the service. Before taking formal action, users are encouraged to contact support and allow a reasonable opportunity for internal resolution.

Users should submit accurate facts and preserve communication records when raising disputes. Nothing in this section prevents a user from approaching an official government or legal forum where the user has a lawful right to do so, but false, abusive, or malicious claims may be treated as misuse.

18. Policy Updates and Contact

These Terms may be updated to reflect product changes, business changes, law, security requirements, pricing changes, provider updates, or operational learning. The latest version will be made available on this page with a Last Updated date. Material changes may also be notified through the product, email, or dashboard where practical.
